These Terms and Conditions (“Terms”) govern your access to and use of the online shop www.digitorum.eu (“Website” or “E-shop”), operated by Digitorum (the “Seller”, “we”, “our” or “us”). By placing an order, the customer (“Buyer”, “you”) agrees to be bound by these Terms.
1. General Provisions
1.1. These Terms constitute a legally binding agreement between the Buyer and Seller for the purchase of goods on the Website.
1.2. By placing an order, the Buyer confirms having read, understood, and accepted these Terms.
1.3. A purchase-sale agreement is considered concluded once the Buyer:
• adds products to the cart,
• enters a valid delivery address,
• selects a payment method,
• reads and agrees to these Terms,
• clicks on “Confirm Order”.
2. Privacy and Data Protection
2.1. The Seller processes Buyer’s personal data in compliance with the General Data Protection Regulation (GDPR) and local privacy laws.
2.2. To place an order, the Buyer must provide accurate information including name, address, phone number, and email. This data is used solely for order processing and fulfillment.
2.3. The Buyer is responsible for the accuracy of submitted data. Outdated or false data must be corrected or updated immediately.
2.4. By placing an order, the Buyer consents to the processing of personal data for the purpose of executing the contract.
2.5. Marketing communication is only sent if the Buyer has given clear, prior, and informed consent.
2.6. The Seller will not disclose personal data to third parties unless:
• required by law,
• required for order delivery (e.g. logistics providers),
• Buyer provides explicit written consent.
2.7. Buyers have the right to:
• access their data,
• correct or delete data,
• withdraw consent at any time,
• lodge a complaint with a data protection authority.
3. Buyer’s Rights and Obligations
3.1. The Buyer agrees to pay the full price of the order and any applicable delivery costs.
3.2. The Buyer must ensure all information provided during registration is correct and complete.
3.3. The Buyer must promptly update account details if they change.
3.4. The Buyer has the right to withdraw from the contract as described in Section 8.
3.5. The Buyer agrees to use the Website in accordance with applicable laws and these Terms.
4. Seller’s Rights and Obligations
4.1. The Seller provides access to the E-shop and ensures its operation under standard conditions.
4.2. The Seller reserves the right to restrict or revoke the Buyer’s account in case of misuse, fraud, or violation of the Terms.
4.3. The Seller commits to protect personal data according to Section 2.
4.4. The Seller undertakes to deliver goods to the address specified by the Buyer.
4.5. In case of force majeure (e.g., system failure, war, strike, pandemic), the Seller may suspend or terminate the operation of the Website without prior notice.
4.6. The Seller reserves the right to unilaterally amend these Terms. Continued use of the Website after changes implies Buyer’s consent.
4.7. The Seller may delete inactive accounts after 12 months of inactivity.
5. Ordering, Prices, Payment
5.1. Orders can be placed 24/7 via the Website.
5.2. Orders may also be made with assistance from our customer service team.
5.3. All prices are in Euros. The Seller is not a VAT payer unless otherwise stated.
5.4. Accepted payment methods:
• Direct bank transfer,
• Paysera,
• PayPal.
5.5. Orders must be paid within 10 calendar days of confirmation. Unpaid orders are automatically canceled.
6. Delivery
6.1. Buyer must provide a valid and complete delivery address.
6.2. The Buyer or an authorized person must accept the delivery. Claims for non-received goods are not accepted if the delivery address was correct and delivery attempted.
6.3. Delivery is handled via Lithuanian Post, DPD, or other courier partners.
6.4. Goods are shipped within 1–2 business days after payment confirmation.
6.5. Estimated delivery times:
• Lithuania: 2–3 business days,
• Latvia & Estonia: 2–4 business days,
• Other EU countries: 7–14 business days.
6.6. The Seller is not liable for delivery delays caused by the Buyer or force majeure events.
6.7. Damaged or incomplete parcels must be reported immediately. Buyer must submit photographic evidence via email.
6.8. If a package is returned due to an incorrect address or unclaimed from a terminal, the Buyer must cover re-shipping and return costs. Original shipping fees are non-refundable in such cases.
7. Product Information and Warranty
7.1. Product descriptions, photos, and prices are displayed on individual product pages.
7.2. Photos are illustrative; actual product appearance may vary slightly due to lighting, screen resolution, or batch variations.
7.3. If applicable, warranty terms are specified in the product description.
8. Returns and Refunds
8.1. Goods can be returned within 14 days of delivery, in accordance with EU consumer rights directives.
8.2. To initiate a return, Buyer must:
• notify the Seller via email,
• complete the “Product Returns” form,
• attach photos or video proof.
8.3. Goods must be unused, in original packaging, with all labels intact, and include a printed purchase receipt.
8.4. Return postage for quality goods is paid by the Buyer. Only product price is refunded.
8.5. If goods were shipped by mistake or are faulty, the Seller:
• replaces them (if possible), or
• refunds the full amount including shipping.
8.6. Gift cards and coupons are refunded as credits. Discounted items are refunded based on the amount paid.
8.7. The Seller reserves the right to reject returns if the conditions above are not met.
9. Promotions and Communication
9.1. The Seller may offer time-limited promotions or discounts on the Website.
9.2. Promotional terms may be modified or terminated without notice.
9.3. Communication is made via email. Buyer is responsible for checking inbox and spam folders.
9.4. Buyer inquiries must be sent using the “Contacts” form on the Website.
9.5. The Seller is not liable for failed communication due to incorrect email, spam filters, or connectivity issues.
10. Final Provisions
10.1. These Terms are governed by the laws of the Republic of Lithuania.
10.2. Disputes shall first be resolved through negotiation. If unsuccessful, they will be settled in Lithuanian courts.
10.3. In the event of discrepancies between language versions of these Terms, the Lithuanian version shall prevail.
